Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“the Client”) and Savannah Trails Kenya (“the Company,” “we,” “us,” or “our”), a tour operator registered and operating under the laws of the Republic of Kenya. By making a booking or inquiry through our website, WhatsApp, email, or any other channel, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Booking and Confirmation

  • All bookings are subject to availability and are confirmed only upon receipt of a written confirmation (via email or WhatsApp) from the Company and payment of the required deposit.
  • A non-refundable deposit of thirty percent (30%) of the total tour cost is required to secure any booking. The remaining balance shall be payable no later than fourteen (14) days prior to the tour commencement date.
  • Bookings made within fourteen (14) days of the tour commencement date require full payment at the time of booking.
  • Prices quoted are in United States Dollars (USD) or Kenyan Shillings (KES) as indicated and are subject to change without notice prior to booking confirmation.

3. Cancellation and Refund Policy

Cancellations must be communicated in writing (email or WhatsApp). The following cancellation charges shall apply:

The Company reserves the right to cancel or modify a tour due to force majeure events, including but not limited to adverse weather conditions, civil unrest, government travel advisories, pandemics, or wildlife management closures. In such cases, the Company shall offer an alternative date or a full refund at its discretion.

4. Travel Insurance

The Company strongly recommends that all clients obtain comprehensive travel insurance prior to departure. Such insurance should cover, at minimum: trip cancellation, medical expenses (including emergency evacuation), personal accident, baggage loss, and travel delay. The Company shall not be held liable for any losses arising from the Client’s failure to obtain adequate travel insurance.

5. Health, Safety, and Fitness

  • Clients are responsible for ensuring they are medically fit to undertake the selected tour. Certain tours may involve physical activities including walking on uneven terrain, exposure to wildlife, and travel in remote areas with limited medical facilities.
  • Clients must disclose any pre-existing medical conditions, allergies, or dietary requirements at the time of booking.
  • The Company reserves the right to refuse participation to any Client whose condition may pose a risk to themselves or others.
  • Clients are advised to consult their physician regarding necessary vaccinations and prophylactic medications (e.g., anti-malarial medication) prior to travel.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its directors, employees, agents, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or in connection with:

  • Injury, illness, death, loss, or damage to person or property during the tour, howsoever caused, except where such loss or damage arises directly from the Company’s gross negligence;
  • Delays, cancellations, or changes in itinerary caused by third-party service providers (airlines, hotels, government authorities);
  • Loss or damage to personal belongings, luggage, or valuables;
  • Acts of God, force majeure, civil disturbance, terrorism, pandemics, or government actions beyond the Company’s reasonable control.

The Company’s total aggregate liability shall in no event exceed the total amount paid by the Client for the specific tour giving rise to the claim.

7. Wildlife and Environmental Responsibility

  • Clients must adhere to all rules and regulations of national parks, game reserves, and marine parks as directed by the Kenya Wildlife Service (KWS) and our guides.
  • Approaching, feeding, or provoking wildlife is strictly prohibited and may result in immediate termination of the tour without refund.
  • Clients shall not litter, remove flora or fauna, or engage in any activity that may cause environmental harm.
  • The Company operates under the principles of responsible and sustainable tourism and expects all clients to respect the environment and local communities.

8. Intellectual Property

All content on this website, including text, images, graphics, logos, and design, is the property ofSavannah Trails Kenya and is protected by the Copyright Act of Kenya (Cap. 130). Unauthorised reproduction, distribution, or use of any content without prior written consent is strictly prohibited.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved amicably within thirty (30) days, it shall be referred to arbitration in Nairobi under the Arbitration Act, 1995 of Kenya. The language of arbitration shall be English.

10. Amendments

The Company reserves the right to amend these Terms at any time. Amendments shall take effect upon publication on this website. Clients are encouraged to review these Terms periodically. Continued use of our services following any amendments constitutes acceptance of the revised Terms.
